Terms of Supply

These Terms of Supply (“Terms”) apply to the supply of products by Eco Surf Supply Australia Pty Ltd (“ESSA”, “we”, “us” or “our”) to customers (“you” or “your”).
By placing an order with ESSA, you acknowledge and agree to these Terms.
1. Products
ESSA supplies surfboard blanks, components and related products for use in surfboard manufacturing and shaping.
Product specifications, dimensions, weights, colours, availability and other characteristics may vary slightly between individual products due to the nature of natural and plant-based materials and the manufacturing process.
Images and descriptions on our website are provided as a general representation of the products and may not reflect every individual blank.
2. Orders
Orders may be placed through our website, by email or through other channels agreed with ESSA.
An order is not confirmed until ESSA has accepted the order and, where applicable, received the required payment or deposit.
We reserve the right to decline or cancel an order where products are unavailable, incorrectly priced, incorrectly described, or where we reasonably believe an order cannot be fulfilled.
For pre-orders, estimated arrival and delivery dates are provided in good faith and may be affected by manufacturing, shipping, customs or other circumstances outside our reasonable control.
3. Pricing
All prices are stated in Australian dollars unless otherwise specified.
Unless expressly stated otherwise, prices shown on our website are exclusive of Australian GST where applicable.
ESSA reserves the right to change prices at any time. Price changes will not affect orders that have already been accepted and paid for.
Wholesale, trade, volume or other discounted pricing may be subject to separate terms agreed with ESSA.
4. Payment
Unless otherwise agreed in writing, payment must be received in full before products are released for collection or delivery.
For pre-orders, ESSA may require a deposit to secure the order, with the balance payable before the products are released.
ESSA does not generally offer credit terms unless expressly agreed in writing.
5. Delivery and Collection
ESSA will arrange delivery or collection according to the method agreed at the time of purchase.
Delivery timeframes are estimates only and may be affected by freight providers, customs, weather, delays, industrial action or other circumstances outside our control.
Risk in the products generally passes to you upon delivery or collection.
You are responsible for providing accurate delivery information and ensuring that the delivery location is suitable for receiving the products.
Additional delivery charges resulting from incorrect or incomplete delivery information may be charged to you.
6. Inspection Upon Delivery
You should inspect your products as soon as reasonably practicable after delivery or collection.
If you believe a product has been damaged during transit or contains a manufacturing defect, please contact ESSA as soon as possible and provide photographs and relevant details.
Where appropriate, ESSA may request that the product be returned for inspection.
7. Returns and Exchanges
Because surfboard blanks are specialised products and may be altered, shaped or otherwise modified after purchase, returns are generally not accepted where a product has been cut, shaped, sanded, modified or otherwise worked on.
If a product is faulty or does not conform to the agreement, your rights under applicable Australian consumer law remain unaffected.
For change-of-mind returns, ESSA may accept a return at its discretion provided the product is unused, unmodified and in its original condition. Any applicable return freight costs may be the responsibility of the customer.
8. Natural Material Variation
Agave blanks contain natural plant fibres and materials. Variations in fibre pattern, density, colour, texture and other characteristics may occur between individual blanks.
These variations are inherent to the nature of the material and are not necessarily defects.
Minor imperfections, variations or differences that do not materially affect the intended use or structural integrity of the blank will generally not constitute a manufacturing defect.
9. Shaping and Use
ESSA products are supplied as surfboard blanks and manufacturing materials, not as finished surfboards.
The customer is responsible for determining whether a particular blank, construction method, resin system, glassing schedule or other manufacturing process is appropriate for their intended application.
Customers should follow ESSA’s shaping and handling recommendations and exercise appropriate care when working with the material.
Once a blank has been shaped, modified or incorporated into a finished surfboard, ESSA cannot accept responsibility for issues arising from the shaping, construction, glassing, finishing or other manufacturing processes undertaken by the customer or third parties.
10. Product Information and Technical Guidance
ESSA may provide technical information, shaping guides, recommendations or other guidance regarding the use of our products.
Such information is provided in good faith and is intended as general guidance. The customer remains responsible for testing and determining the suitability of the material for their particular application.
Where appropriate, professional shapers and manufacturers should conduct their own testing before commercial production.
11. Consumer Guarantees
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law or any other applicable legislation.
Where a product is defective or does not meet a consumer guarantee, ESSA will provide the remedy required by law.
12. Limitation of Liability
To the extent permitted by law, ESSA will not be liable for indirect, incidental or consequential loss arising from the use of our products, including loss of profits, production delays or loss of business.
Nothing in these Terms excludes liability that cannot lawfully be excluded under Australian law.
13. Intellectual Property
All intellectual property contained in ESSA’s website, branding, product documentation, photographs, graphics, technical materials and other content remains the property of ESSA or its respective owners.
You may not reproduce, modify, distribute or commercially exploit this material without prior written permission.
14. Force Majeure
ESSA will not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances reasonably beyond our control, including natural disasters, shipping delays, customs issues, industrial disputes, government action, supplier disruptions or other unforeseen events.
15. Changes to These Terms
ESSA may update these Terms from time to time.
The version published on our website at the time an order is accepted will generally apply to that order.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any dispute arising in connection with these Terms will be subject to the applicable courts and tribunals of New South Wales, Australia.
